Terms of Use

1. Acceptance and scope

By using jamesugbanu.com, its chat and voice assistant, or its booking features, you agree to these Terms of Use and the Privacy Policy. If you do not agree, do not use those features.

The site is a personal portfolio operated by James Ugbanu, an individual. No company, registered address, or separate legal entity is claimed.

2. Permitted use

You may use the site to learn about James Ugbanu's professional work, ask relevant questions, explore portfolio evidence, and request or confirm a genuine appointment. You are responsible for the accuracy of information you submit.

3. Prohibited use

You must not:

• attempt to access another person's session, calendar, account, or private information;
• submit false booking details, impersonate another person, or make repeated or automated booking attempts;
• interfere with the site, bypass rate limits or authentication, introduce malware, scrape at scale, or probe for vulnerabilities without authorization;
• instruct the assistant to override its safety or grounding rules, or use it to generate unlawful, abusive, or harmful content;
• use the site in violation of applicable law or the rights of another person.

4. AI assistant limitations

The assistant uses retrieval-augmented generation and third-party AI models. Responses can be incomplete, outdated, or inaccurate, and may misunderstand a question or a voice transcript. Verify important information before relying on it.

The assistant is not James himself and does not create a professional, employment, fiduciary, or client relationship. It does not provide legal, financial, medical, or other professional advice.

5. Bookings and confirmations

Displayed times are availability indicators, not reservations. A booking is confirmed only after the server revalidates the slot, Google Calendar accepts the event, and the booking service returns a confirmed result. You may receive a calendar invitation or event link.

Availability, durations, buffers, notice periods, blocked dates, and the booking switch are controlled by the owner. The owner may change availability or disable new bookings without cancelling existing appointments.

If a slot disappears, the Calendar API fails, or the result is uncertain, the assistant must not claim confirmation. Do not retry blindly after an uncertain result; contact the owner using the contact details below.

You are responsible for providing an accurate name, email address, timezone, and selected time. Times are interpreted in the owner's configured timezone and displayed in your browser's timezone where available.

6. Cancellation and rescheduling

Self-service cancellation and rescheduling are not currently implemented. If you need to change or cancel a confirmed appointment, contact the owner at the address below. Existing calendar events are not automatically modified when availability settings change.

7. Information you submit

Do not submit passwords, financial account numbers, health information, government identifiers, or other highly sensitive information through the assistant, voice interface, contact request, or booking form. You are responsible for having the right to provide any information you submit.

8. Intellectual property

The portfolio content, site design, and original materials are owned by James Ugbanu or used with permission. You may view the site and quote short excerpts with attribution for personal, informational, or professional-evaluation purposes. You may not republish substantial content, scrape it at scale, train models on it, or use it commercially without permission.

Third-party trademarks, project names, and linked materials remain the property of their respective owners.

9. Third-party services

The site links to and integrates with third-party services including Google Calendar, hosting, database, AI, email, and voice infrastructure providers. Their terms and privacy policies apply to their services. The operator is not responsible for third-party sites, content, or availability.

10. Availability and changes

The site and assistant are provided on an as-available basis. Features may be changed, suspended, or discontinued, and scheduled maintenance or provider outages may interrupt service. No service-level guarantee or guaranteed response time is offered.

Voice calls are subject to duration, quota, concurrency, and abuse limits. Booking is subject to owner availability and third-party Calendar operation.

11. Disclaimers and limitation of liability

To the maximum extent permitted by applicable law, the site and its content are provided without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, or uninterrupted availability. AI-generated content and voice transcripts may contain errors.

To the maximum extent permitted by law, the operator is not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, opportunity, or goodwill arising from use of the site, assistant, voice service, or booking features. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

12. Suspension or termination

The operator may suspend or block access, voice sessions, contact submissions, or booking attempts that appear abusive, fraudulent, automated, unlawful, or harmful to the service or another person. Existing confirmed appointments may be handled separately and are not automatically cancelled.

13. Governing law and disputes

These Terms are governed by the laws of the Federal Republic of Nigeria, without regard to conflict-of-law rules, except where mandatory consumer protections in your jurisdiction provide otherwise. The operator is an individual; no company registration or address is claimed.

Before starting formal proceedings, contact jamesugbanu@gmail.com so the issue can be reviewed. Nothing here prevents either party from seeking relief where applicable law gives a non-waivable right.
